FRCA Investigates Lawyers On Capital Gains Tax Exemptions Refund

A number of complaints have been received against some lawyers who are claiming Capital Gains Tax exceptions from the Fiji Revenue and Customs Authority but not passing this onto taxpayers.
FRCA acting chief executive, Visvanath Das, said the authority is advising taxpayers to be vigilant over this.

“In one such complaint, a lawyer collected 10 per cent of gain on sale of a property as CGT tax payable to FRCA on a first residential property that was eligible for CGT exemption, and was in fact exempted,” he said.

“FRCA is concerned with such practices and will be making complaints to the Legal Practitioners Unit against lawyers involved in such practices.”

FRCA is urging taxpayers who have doubts over their CGT exemption certificates to verify their application status with Alipate Ledua on 3243819 or email aledua@frca.org.fj.
