Government To Look At Fiji Data Bureau Legality

In the new year, Government will be analysing the operations of the Fiji Data Bureau and looking at its legality.

The Attorney-General and Minister for Finance, Aiyaz Sayed-Khaiyum, highlighted yesterday that the Fiji Data Bureau does not have any legislative framework nor does it have any legislative backing.

“It is simply a company that has been started up by some financiers and other people who have some shareholding in it and there are people having their names reported to it,” he said.

Mr Sayed-Khaiyum was speaking during the Consumers Rights to Redress in Financial Services Workshop organised by the Consumer Council of Fiji yesterday.

He stressed people generally are forced to consent to this particular system whether they want to or not.

Mr Sayed-Khaiyum stated as a result, there are breaches in many respects as far as the Data Bureau is concerned – even in the Constitution provisions.

“We will be in the new year looking at the whole basis of the Data Bureau itself and why and how should all other financial institutions use it,” he revealed.

Abuse

Mr Sayed-Khaiyum said Government had noted an abuse in the system as well where sometimes companies even for $10 non-payment were reporting people to the Data Bureau.

“So when these people go to some hire purchase company or bank, they are told they are listed on the Data Bureau,” he said.

“That obviously is not right and it needs to be regulated. We will ensure that in the next one year or so there will be some new laws that will be put in place to ensure this is regulated.

“There needs to be certain rules around this and there needs to be legal recognition of such an organisation.”
