Bail ruling set for April 7

 

A 26-year-old electrician of Nepani, who is charged with stabbing a salesman, also aged 26, last Saturday, has been further remanded in custody.

Ashwin Ashneel Kumar appeared before Magistrate Sufia Hamza at the Nasinu Magistrates Court yesterday.

Kumar is charged with one count of act with intent to cause grievous harm. The charges were read out to Kumar in court and he indicated he understood.

The court heard that Kumar allegedly injured the victim by stabbing him with a knife.

Police prosecution objected to bail citing that it was an indictable offence and said Kumar needed to be remanded in custody for his safety.

Defence made a bail application and informed the court that Kumar needed to be released on bail because he had vehicle and hire purchase payments that would be affected if he was remanded.

The defence also argued that Kumar was married with one child and operated his own business from home.

They also claimed that there was no medical report disclosed to them to determine that the victim suffered grievous bodily harm.

The prosecution said the victim was in a serious condition and under observation at the Colonial War Memorial Hospital’s Acute Ward.

Prosecution said the victim would be under observation for 15 days and the doctor could not reveal much at this stage.

The defence again argued that a person under observation does not stop a doctor from producing a medical report.

Magistrate Hamza then ordered that Kumar be further remanded in custody until his bail ruling on April 7.
