A 23-year-old man has been sentenced for 10 years by the High Court in Labasa after being found guilty of raping a minor on two separate occasions in 2012 and 2014.

The court heard that the victim, who was 13 years old in 2012, had been sleeping at the accused’s house with her father and close relatives when he led her to a separate room and had sexual intercourse with her.

The accused, who is the victim’s uncle, repeated the offence in 2014, dragging the victim to a secluded spot and raping her while she was returning from church.

Following the incident the victim related everything to her father who lodged a report with Police.

The court held that since the victim was under the age of 13 during the time of the two separate incidents, consent was not an issue in the case.

In summing his judgement High Court judge Justice Paul Madigan said that apart from his mitigating features advanced on the accused’s behalf by the council, it was a credit that no violence was occasioned to the victim in both of the incidents.

Justice Madigan took a starting point for the first count of rape of 12 years adding that there was nothing to add for aggravating factors therefore deducting two years for the accused’s considerable mitigation including his young age and clear record.

No non-parole period was set by Justice Madigan, who spoke of the opportunity for rehabilitation of a young man.
