Judge says rape as a crime has become too frequent

 

Three men convicted of rape were sentenced to 10 years 10 months and two weeks each by the High Court in Suva yesterday.

The court facts stated that on October 10, 2012 the victim went swimming and lost her phone.

In the process of looking for her phone she was gang raped by six to seven boys in a cave in Tovata.

The first-accused had gone to help the girl in the gang rape in the cave but when he brought her to a vacant house he had asked her consent to having sexual relations with him.

The vacant house was where the second gang rape occurred involving the three accused.

The prosecution had stated during the closing submissions that different people react differently after being raped and that is how the victim reacted by giving consent.

The victim was only 13 years of age at the time of the incident.

Justice Achala Wengapulli said “rape as a crime has become too frequent.”

Justice Wengapulli said the perpetrators took advantage of the victim as she had just been raped.

All three accused are guilty of one count each of rape.

The three were given a non-parole imprisonment period of eight years, 10 months and two weeks.
