Texting competitions are fast becoming a quick, easy and convenient method to run promotions and competitions by organisers.

Ever since the introduction of mobile phones in Fiji, mobile texting competitions have been introduced and it has gained momentum over the years.

Virtually mobile texting platforms are being used to conduct and facilitate a wide range competitions and promotions in Fiji.

This ranges from listeners texting for their favourite singers, favourite sports personality, Sportsman and Sportswoman of the Year Award, selection of teams to participate in sporting events, texting to win recharge cards and include competitions organised by the radio and television stations in Fiji.

Texting competitions are fast becoming a quick, easy and convenient method to run promotions and competitions by organisers.

It also generates revenue for the media outlets and the mobile companies on a revenue sharing basis.

Texting competitions and promotions (or related transactions via mobile phone) market in Fiji has become a high growth market ever since its inception.

 

Market players

The current market structure consists of the following major players engaged in the designing, conducting, sponsoring, providing texting platform and administration of the various forms of texting competitions, promotions and advertisements in Fiji are:

Fiji Television Limited (Fiji TV)

Fiji Broadcasting Corporation Television (FBC TV)

Mai TV

Communications Fiji Limited (CFL)

Fiji Broadcasting Corporation (FBC) and FBC TV

Vodafone Fiji Limited

Digicel (Fiji) Limited

Guidelines for texting competitions and promotions in Fiji

  1. All texting promotions must be organised and conducted in a fair and transparent manner;

 

  1. Parties involved in the texting competition must have a written agreement with the platforms and network providers, which should be kept confidential by the parties; unless required by relevant authorities including the Fiji Commerce Commission;

 

  1. Promotional material must clearly state any information which is likely to affect a decision to participate, including:

n the closing date;

n any significant terms and conditions, including any restriction on the number of entries or prizes which may be won;

n an adequate description of prizes, and other items offered to all or a substantial majority of participants, including the number of major prizes;

n any significant age, geographic or other eligibility restrictions;

n any significant costs which a reasonable consumer might not expect to pay in connection with collection, delivery or use of the prize or item.

 

  1. There must be no misleading or deceptive conduct attached to any texting competition.

For example; Misleading and highly enticing phrases like “text and win” “You are X number of texts away from winning the Prizes” must not be used;

 

  1. All the terms and conditions should be easily accessible to the general public;

 

  1. The party, who initiates or promotes a competition to consumers, should bear liability and not third parties unbeknown to consumers;

 

  1. All texting competitions should specify the opening/closing time and date.

Once the closing date for a competition is reached, the advertised prizes must be awarded, notwithstanding the number of entries.

Radio stations need to also provide a closing time for texting competitions;

 

  1. Draws must be done in a transparent manner with records kept properly for verifications by third party;

 

  1. Mobile phone operators and promoters of texting competitions/promotions should provide an avenue to consumer to raise complaints in regards to a competition in which they have participated in;

 

  1. All texting competitions and promotions should provide eligibility conditions.

It is recommended that children under 16 years of age should seek their parents’ consent before entering into a competition;

 

  1. Winners of texting competitions must be disclosed. Prizes must be awarded within 28 days of the closing date, unless a defined lesser period is clearly stated in the promotional material;

 

  1. Competition services and promotional material must not:

nuse words such as ‘win’ or ‘prize’ to describe items intended to be offered to all or a substantial majority of the participants;

n exaggerate the chance of winning a prize;

nsuggest that winning a prize is a certainty;

n suggest that the party has already won a prize and that by contacting the promoter thw at the entrant will have definitely secured that prize.

 

  1. The following additional information must also be made readily available on request, if not contained in the original promotional material:

n how and when prize-winners will be informed; the manner in which the prizes will be awarded; when the prizes will be awarded;

n how prize-winner information may be obtained;

n any criteria for judging entries;

nany alternative prize that is available;

n the details of any intended post-event publicity;

nany supplementary rules which may apply;

n the identity of the party running the competition and responsible for the prizes.

nFull terms and conditions of the Competition, Promotion or Advertisement;

 

  1. Non-cash prizes must not be redeemable for cash or transferrable. Prizes not claimed within the stated period shall be forfeited;

 

  1. Texting competitions involving chance and winning of money or money’s worth shall be deemed lotteries and be subject to the Gaming Decree 2009 and other relevant laws and regulations covering lotteries.
