Koroilavesau Clarifies Workers Pay on Special Public Holiday

The Minister for Employment, Productivity and Industrial Relations Semi Koroilavesau yesterday clarified that a worker who is employed on any of the gazetted public holidays is entitled to public holiday pay.

The Minister highlighted that under section 67 of the Employment Relations Promulgation (ERP) 2007 a worker must be paid in respect of each public holiday for the number of hours which the worker would normally have worked on that day had it not been a public holiday.

“I am clarifying this as Monday is a special Public Holiday to celebrate with our Olympic heroes, and if a worker is employed on Monday 22 August 2016, then he/she is entitled to double pay,” Minister Koroilavesau said.

“A worker who is not required to work on Monday will still be entitled to public holiday pay but on a single rate.”

“The prerequisite for this entitlement is that the worker must be at work the day before and after the public holiday and if they are unable to do so then they must provide a valid reason or a medical certificate.”

Minister Koroilavesau appealed to all employers who will be operating during this day to remunerate their workers accordingly.
