A man charged with manslaughter was acquitted by the High Court in Lautoka last Thursday. Justice Aruna Aluthge said he was satisfied with the defence and the assessors’ verdict that driver Mohammed Farun Yakub was not guilty of manslaughter.

“I concur with the unanimous opinion of the assessors and find the accused not guilty of manslaughter,” Justice Aluthge said

It was alleged that on December 8, 2009, Yakub unlawfully killed Suresh Chandra by an omission to exercise his duty of care over an inanimate object when he switched on the bus causing it to move forward and hit the deceased.

There were no eyewitness who saw Yakub starting the bus or sitting in the driver’s seat at the time of the accident. Yakub had stated to Police that the bus had started on its own and that he had intervened to save the people who were walking in-front of the bus.
