Judge Refuses Application By Supervisor Of Elections

Suva High Court judge, Justice Lyone Seneviratne, has refused an application by the Supervisor of Elections to strike out an action by the National Federation Party.

This means that the court will go ahead and hear a notice of an originating motion in which the NFP is challenging the Supervisor of Elections’s decision in February to suspend the party for 30 days.

The ground for suspension was that the auditor who certified the  NFP accounts did not have a Certificate of Public Practice as required by section 22 of the Fiji Institute of Accountants Act.

Justice Seneviratne said that the fact that the NFP rectified the defect pointed out by the Supervisor of Elections did not disqualify the party from challenging the validity of the suspension decision.

“In the circumstances, I hold that the appellants have sufficient grounds to proceed further with this matter,” the judge said.
