Application To Strike Fiji Times Review Bid

The Attorney-General’s chambers has filed an application to strike out the judicial review bid by Fiji Times lawyers.

The action is over a case of a decision by the Acting Permanent Secretary for Communications to award Fiji Sun as the print media – newspaper organisation for the publication of Government advertisements and notices for 2016.

The application to strike out the judicial review with costs is made on the grounds that it disclosed no reasonable cause of action, it is frivolous and vexatious and it is an abuse of the court process.

The matter is fixed for hearing today.

The civil matter was called before Judge Justice Deepthi Amaratunga at the Suva High Court on Wednesday.

Fiji Times, the Permanent Secretary for Communications and Fiji Sun (the interested party) have sought time to file an affidavit in reply to the strike out application.

Emmanuel Narayan of Patel Sharma Lawyers appeared for Fiji Sun, Jon Apted of Munro Leys appeared for Fiji Times and Sophina Ali of Attorney-General’s Chambers appeared for the Solicitor-General.

The hearing for the judicial review is set for September 23.
