Accused was intially charged with rape, but judge says prosecution had failed to present credible evidence.

A man’s honesty and remorsefullness has helped reduce his sentence and lessen his charge.

A High Court judge in Suva yesterday gave a partly suspended sentence to an accused convicted of defilement.

Justice Vincent Perera told the accused: “You have accepted the responsibility of your action and this I consider as remorse.”

The accused, 20, has been convicted because of his confession of having sex with the complainant since they were in a relationship for a year. The initial charge was of rape, but the prosecution had failed to present credible evidence and the accused was convicted of a lesser charge of defilement.

The court has ordered that from the nine months of sentence, one month will be deducted because of the time spent in remand.

From the eight months he will serve two months. The remaining six months will be suspended for two years.  Edited by Naisa Koroi
