A 53-year-old man has been charged for allegedly raping a 16-year-old girl during a drinking party at his house in Narere, Nasinu.

The case was called at the High Court in Suva before Judge Justice Salesi Temo.

Defence lawyer Filimoni Vosarogo told the court that the complainant was allegedly raped on the first week of November.

Mr Vosarogo said it was alleged that the complainant was rudely awoken from a hangover, after she felt the accused on top of her, engaged in a non-consensual sexual intercourse.

The prosecution told the court that the complaint was lodged against the accused on November 11, after she told her sister.

Prosecutor, Meli Vosawale, representing accused, Savenaca Elliot, argued that the time the report was lodged to Police proved that the alleged incident did not happen.

However, Justice Temo said that people have various reasons for lodging their complaints late, and the word ‘recent’ must be removed.

He said even if the complaint was made after a period of time, at the end of the day, it all depended on the credibility of the allegations.

Mr Vosarogo told the Court that the accused denied the allegation made against him.

He said the accused said he was visited by his nephew at home with another boy the same day, and that he had told the Police that he was not involved with the other friends from that time onwards.

Justice Temo said these type of offences usually happened before Christmas and unfortunately parents cannot stop their daughters from going to parties.

He also added that boys take advantage of girls after they are knocked out.

“Rape is rape, drunk or not drunk,” said Justice Temo.

Mr Vosarogo could not provide the court with a strong reason to keep the accused in remand when asked by Justice Temo.

The accused was granted bail, subject to strict bail conditions.

Elliot is charged with one count of rape.
