The Minister for Defence Ratu Inoke Kubuabola will be subpoenaed to appear as a witness in the trial of suspended Opposition parliamentarian, Ratu Isoa Tikoca.

Tikoca is charged by the Fiji Independent Commission Against Corruption with failing to declare his liabilities before the 2014 General Elections.

Magistrate Makereta Mua granted the order and issued the subpoena after the prosecuting lawyer, Rashmi Aslam, said he had no objection.

Mr Aslam told the court that they did not have any issues with the subpoena being issued to Ratu Inoke because it would assist the court.

Defence lawyer, Kitione Vuetaki told the court they would be abandoning orders one and two that they had sought previously.

Orders one and two were:

  1. That written reasons be given as to why the learned Magistrate presiding over this case directed that the subpoena against Ratu Inoke Kubuabola, the current Minister for Defence, be rejected by the Magistrate Court Criminal Registry and not issued.
  2. If the reasons are that the learned Magistrate presiding over this case fears or favours the said Ratu Inoke Kubuabola or the present Government then the said Magistrate recuse herself from further presiding over this case.

Mr Aslam also told court that prosecution had three witnesses, while Mr Vuetaki told the the court that the defence had three to four witnesses.

It is alleged that he failed to declare his liabilities contrary to Section 24 (2) (a) (viii) and section 24(5) of the Political Parties (Registration, Conduct, Funding and Disclosures) Decree No. 4 of 2013.

The case has been adjourned for a hearing from January 9 to January 13.
