A 19-year-old complainant of rape took the witness stand yesterday to testify how her night out with her uncle and friends took a shocking turn.

Josefa Bera, 25, is charged with one count of rape and Matorino Madogo, 27, is charged with two counts of rape.

It is alleged that on September 11, 2015, at the golf course in Vatuwaqa, Suva, the duo raped a 17-year-old girl.

Both the accused have pleaded not guilty to the charge.

State lawyer Meli Vosawale questioned the complainant on how she knew Bera.

The complainant told the court that Bera used to work with her ex-boyfriend at Temptation 2 Night Club and he had introduced himself to her at least once or twice.

She said that on September 10, 2015, she was invited to Temptation 2 Night Club by her uncle to have some drinks and she did go with a few friends.

Mr Vosawale asked the complainant what had happened in the club, to which the victim said that Bera approached her for a dance.

She said he later kissed her without her consent.

She further said that she did not want to talk to Bera but, he continued to pursue her and said that he wanted to have sex with her.

When Mr Vosawale asked her why she had agreed to go home with Bera, she said that she knew him and trusted him.

The court heard from the complainant that while boarding the taxi from the club, Madogo also entered the cab and sat in front with the driver.

She told the court that they stopped the cab at the golf course where they got off and Bera told her not to worry as they wanted to drink more alcohol.

The complainant said after she refused to drink Chinese whisky, Bera grabbed hold of her hand and dragged her a few steps away, and allegedly raped her.

She said while being allegedly raped by Bera she could hear Madogo saying in iTaukei language that he also wanted to join him.

She told the court when Bera got off her, she was shocked and scared.

In panic, the complainant said when she tried to escape the duo, Bera grabbed her from behind while his accomplice, Madogo allegedly raped her.

Under cross examination by Bera ‘s defence lawyer, Christina Choy, told the complainant that she had agreed to go home with Bera knowing that he wanted to have sex with her, to which she agreed because she trusted him.

Ms Choy further suggested to her that she willing had sex with Bera because she didn’t scream when she was being allegedly raped.

She responded saying that the only person close by was Madogo.

The case continues today.
