FRA files court order for MWH time sheets

The Fiji Roads Authority (FRA) stated yesterday that it wanted the MWH New Zealand Limited’s timesheets from January 1, 2012, till the termination date on September 23, 2016.

The case was called before Judge Justice Lyone Seneviratne at the High Court in Suva yesterday.

FRA lawyer Devanesh Sharma told the court that FRA was entitled to the timesheets as it was covered in the contract.

He further stated that those timesheets related to the work undertaken by MWH for FRA and showed the time spent by the MWH employees for the work carried out.

Mr Sharma told the court that one of the ways of billing MWH was from the timesheets, and he further said that FRA was entitled to see how the expenditure occurred and they were also entitled to audit the same.

Mr Sharma sought an order from court for MWH to provide the timesheets that were relevant and were created during the time of the contract within seven days.

MWH lawyer, Robert Craig, told the court that the timesheets were not part of the confidential agreement.

He further said that the obligation was only to return the information that were supplied by FRA.

Mr Craig said: “Timesheets are not gained, but prepared through confidential information.”

He said that as per the first part of the clause, it stated that at the end of the service one must return any property of the client.

He further stated that there was no term in the contract that related to the timesheets.

Mr Craig made a submission that FRA’s application be dismissed.

The ruling will be made on April 26.
