Legal advice will be sought from the Solicitor General’s office by the Ministry of Health after objections by the Human Rights and Anti-Discrimination Commission regarding the World Health Organisation’s regulations on blood donations.
The Permanent Secretary for Health Phillip Davies said: “We are seeking advice on whether the current regulation is constitutional.”
HRADC director Ashwin Raj said the WHO document was a guideline and not legally enforceable but the constitution was.
He said significant strides had also been made globally including Fiji in recognising the rights and inherent dignity on the grounds of sexual orientation, gender identity and expression.
