A 38-year-old man pleaded not guilty to one count of disabling in order to commit an offence.
The matter was called before Justice Salesi Temo at the High Court in Suva yesterday.
Vijay Kumar is alleged to have suffocated a woman in water with intent to assault her, rendering her incapable of resistance. Kumar had pleaded guilty before however the court was told he wished to change his plea.
Defence lawyer, Vilisoni Tuicolo, is representing Kumar and Sujata Lodhia is representing the prosecution.
The case has been adjourned to June 5, for the State to discuss the case theory.
