Lolohea, 56, pleads not guilty to murder of de facto partner

A 56-year-old man charged with the murder of his 24-year-old de facto partner pleaded not guilty yesterday at the High Court in Suva.

Judge Justice Salesi Temo said: “A lot of accused forget the benefit of a guilty plea and the discount given.”

It is alleged that Timoci Lolohea, on March 20, 2017 murdered Elenoa Dicovi by stabbing her with two knives.

State lawyer Meli Vosawale discussed the case theory and told the court that Lolohea allegedly stabbed Ms Dicovi several times which substantially contributed to her death. Mr Vosawale said the State would rely on the element of intention and of recklessness in causing Ms Dicovi’s death, the evidence of two witnesses who saw Lolohea allegedly stab the victim, and the post mortem report.

Mr Vosawale said Lolohea admitted to allegedly stabbing Ms Dicovi and witnessing her bleed. However, defence lawyer Abhay Singh told the court that he would challenge the confession.

The case has been adjourned to June 26, for mention.

Rapist stepdad sentencing on Monday

A stepfather was convicted yesterday for one count of rape and four counts of sexual assault by the High Court in Suva.

The judgement was delivered by Justice Riyaz Hamza.

The accused, between March 19, 2016 and March 26, 2016 in Suva raped and sexually assaulted his 15-year-old stepdaughter.

It was established during the one-week trial that the accused used to sleep in the same room with the complainant, the complainant’s mother and her stepsiblings.

During the time of the offending the accused around 2am would perform the sexual acts on the complainant, and when she would wake up in tears he would move back to his mattress.

The court was told that every time the accused committed these offences, the victim would wake her mother up and inform her of the incidents, and she would believe her because the accused was the only person in the room.

The victim and her mother testified in court that the accused had sexually assaulted her several times and had also raped her. The accused had pleaded not guilty to all the charges and denied his admissibility in the caution interview.

He will be sentenced on Monday.
