Sentencing :Brother Jailed 3 Years, 9 Months Over Brother’s Death

Suva High Court Judge Justice Vincent Perera said: “Causing the death of another human being over a dispute cannot be taken lightly.”

Justice Perera made this comment when sentencing Aisake Vana Junior to three years and nine months imprisonment for manslaughter with a non-parole period of one year and nine months.

It was stated in court that on April 5, last year, Junior stabbed his younger brother Suliasi Veisere due to a fight they had over a bowl of dhal.

Justice Perera said that Junior got angry while he was cooking because the deceased had sworn at him.

Justice Perera said: “Thereafter you got hold of the knife you were using in the kitchen even after the deceased told you not to take the knife and you stabbed him once on his back.

“To promote well-being in the society, people are expected to exercise a reasonable degree of self-control and tolerance to live and let live.”

For aggravating factors Justice Perera said that Junior caused the death of his own younger brother and after he stabbed the deceased he left; leaving him bleeding.

For mitigating factors the court considered that the domestic oppression Junior has experienced over a period of time seemed to have contributed to what took place on the day of the incident.
