Bulitavu, Karunaratne Lawyers To File No Case To Answer

The lawyers representing an Opposition Member of Parliament, and a businessman charged with spreading seditious comments in public in 2011 will file a no case to answer.

The prosecution yesterday closed its case after a retrial against Mosese Bulitavu and Jagath Karunaratne in the Suva Magistrates Court. Bulitavu and Karunaratne are alleged to have had a hand in the spray painting or graffiti of seditious comments on billboards, buses and retaining walls from Suva to Nausori in 2011.

Defence lawyers Barbara Malimali, representing Bulitavu, and Aman Ravindra-Singh who is representing Karunaratne, told the court of the application. Magistrate Deepika Prakash then gave both lawyers seven days to file their application.

Prosecution lawyer Lisiate Fotifili will respond to the applications by August 11 after which both parties are to present their submissions for argument.

The last prosecution witness, the investigating officer of the case, Inspector Kalusi Seru, during cross examination by Ms Malimali agreed that Bulitavu was not among those who actually did the spray painting.

Inspector Seru also agreed that at the time of the alleged offence, there were other teams spray painting around the country in which a Police officer was also involved.
