COURT : Levuka Man Gets 18 Months For Indecent Assault

Levuka Magistrate Shageeth Somaratne told Mohammed Faiyum that he had exploited his victim’s vulnerability by subjecting her to his lust.

Magistrate Somaratne made the statement when sentencing Faiyum, 26, to 18 months imprisonment for indecent assault.

Faiyum had pleaded guilty to indecently assaulting a 14-year-old student on July 3, 2011.

Magistrate Somaratne said: “The victim who was then a 14-year-old girl had gotten into your truck trusting you and the driver to drop her home.

“You touched her breasts and forcefully kissed her till the vehicle reached the destination and you were aware that the victim was helpless to resist your advances in the truck and you used that to your advantage,” he said

“Your behaviour needs to be denounced with a custodial sentence even though this may bring some misery to your young children.”

For aggravating factors the court took into account the age gap between the victim and Faiyum.

For mitigating factors the court considered that Faiyum was married with two children, has reconciled with the victim, was a first offender and was remorseful for his actions.

Mr Somaratne said that this was not an offence that could be reconciled under the Criminal Procedure Act.
