Defence Submits Mitigating Factors In Ra Sedition Case

Defence lawyers in the Ra sedition case yesterday submitted the mitigating factors before judge, Justice Aruna Aluthge, at Lautoka High Court.

In his mitigation for Ratu Epeli Niudamu’s lawyer Kevueli Tunidau said that he had submitted his client’s character to the judge.

Aman Ravindra Singh, Defence counsel for 2nd- 15th accused (Sailasa Wairoaroa Malani, Sereima Rokodi, Nanise Kasami Nagusuca, Waisea Dualima, Isikeli Kabakoro, Laisiasa Mocevakaca, Emosi Toga, Waisake Racaca, Samuela Ligabalavu, Mikaele Gonerara, Josefa Natau, Sulueti Waqalala, Ulaiyasi Tuivomo and Apolosi Qalilawa), said in his oral submissions of mitigating factors that seven of his clients were not in good health.

He said the second accused Sailasa Wairoaroa Malani had just undergone surgery at Lautoka Hospital.

He also submitted their character references and said his clients had followed the law and all were good citizens.

State Lawyer Lee Burney referred to a case of arson and sedition and said that the punishment for sedition in the case was four and half years imprisonment.

Mr Singh then told the court that the case had arson, which was completely different from sedition. He asked the judge for a suspended sentence.

He said that his clients had only signed certain documents and had not plotted, planned anything against the Government.

The sentencing is scheduled for 2. 30pm today.
