High Court judge Justice Thushara Rajasinghe has dismissed a third application for a bail variation by Fiji Times Publisher Hank Arts.

Arts is charged with sedition along with Fiji Times Limited Editor-in-chief Fred Wesley, Editor Nai Lalakai Anare Ravula and article writer to the Nai Lalakai Josaia Waqabaca.

He had made a bail variation application through his lawyer, Faizal Haniff, to travel to Honolulu, Hawaii, to celebrate his wedding anniversary from October 6 to October 17.

Justice Rajasinghe said Arts had applied for a bail variation because of the pressure of work, the criminal proceedings and that he wanted to get out of Fiji to refresh his mind.

The judge further said there was no evidence produced in court that Arts could not have a vacation here in the country.

“This court has no jurisdiction in restraining Arts in applying for a visa in Honolulu,” said Justice Rajasinghe.

He also said Arts still remained a flight risk adding that the issue was whether he would return to Fiji if he was granted a bail variation by the court.
