A 22-year-old subsistence farmer was sentenced to 12 years in jail yesterday by the High Court in Labasa.

The farmer, representing himself, pleaded guilty to one count of assault causing actual bodily harm and one count of rape.

He appeared before Justice Salesi Temo.

It is alleged that on September 2, 2017 in one of the islands in the Northern Division, the accused assaulted and raped a 68-year-old woman, who was his neighbour.

Justice Temo said the aggravating factors were that there was a breach of neighbouring trust.

He told the accused that by offending against the complainant, he showed no regards to her right as a human being, no regards to her right to safety and freedom and no regards to her right to a happy and peaceful life.

“Your action in attacking and raping a village elder potentially could undermine village peace and harmony; thus you have to accept a prison sentence to teach you not to abuse other people’s trust,” Justice Temo said.

He further said in a village setting, the expected norm was that the old would look after the young ones and the young ones would respect their elders. The accused is eligible for parole after serving 11 years.
