The High Court in Suva yesterday gave a final warning to sedition accused Josaia Waqabaca after he failed to appear on time for his case.

Earlier this month Waqabaca through his lawyer Aman Ravindra-Singh had filed a motion in the High Court Civil Registry arguing for a permanent stay on proceedings against his client.

Mr Singh submitted that the words in the charge contradicted Section 17 of the Constitution for Freedom of Speech and Freedom of Expression.

Waqabaca was initially charged with one count of sedition in a criminal case, as the article writer for vernacular weekly Nai Lalakai, alongside Fiji Times Publisher Hank Arts, Editor-in-chief Fred Wesley and Editor Nai Lalakai Anare Ravula.

During proceedings yesterday, Waqabaca told judge Justice Thushara Rajasinghe that Mr Singh was appearing for another matter in the High Court in Lautoka.

He further sought an adjournment date to today to enable his lawyer to appear in court.

Counsel Andrew Liverpool, who appeared on behalf of Mr Singh told Justice Rajasinghe that Mr Singh had forgotten to inform his client about the court date.

Justice Rajasinghe said Mr Singh’s time management issues were his personal problem and not the court’s problem.

He said Mr Singh should have instructed another counsel to appear on his behalf if he could not be present.

The case has been adjourned to January 19, 2018 for mention.

Waqabaca’s bail was further extended.
