Grandfather Sentenced to 43 Months Jail Time

A 65-year-old grandfather was sentenced to three years and seven months imprisonment yesterday after he was convicted for sexually assaulting his seven-year-old granddaughter.

The man was found guilty on one count of sexual assault where he rubbed an unpeeled banana on the child’s private part when she was staying with him and his wife in 2012. The court found him not guilty of the charge of rape and a second count of sexual assault.

The court heard that the girl was under 13-years-old at the time and her parents were staying in Lautoka.

While sentencing the accused, Judge Justice Vincent Perera said the tariff for sexual assault was between two to eight years with a maximum sentence of 10 years imprisonment.

He highlighted that the aggravating factors were that the victim was under the accused’s care and protection and that there was a serious breach of trust.

Justice Perera said there was an age difference of 52-years between them and that the accused took advantage of his granddaughter’s naivety and vulnerability.

The court heard that the accused had 15 previous convictions with the latest recorded on May 6, 2002 for indecent assault.

Defence lawyer Filimoni Vosarogo had submitted earlier that his client was very remorseful for his actions.

He had been in custody for five months.

The accused was ordered to serve a minimum sentence of two years seven months imprisonment before he could be eligible for parole.

A permanent Domestic Violence Restraining Order was imposed on the accused and he was ordered not to contact the victim directly or by other means unless directed by the court.

He was given 30 days to file an appeal to the Court of Appeal.
