High Court Judge Justice Salesi Temo made an order last Friday for the destruction of 170 marijuana plants equivalent to 21.95 kilograms by the Chief Registrar’s Office, with the assistance of the Police.

Justice Temo made the order following the sentencing of a 24-year-old Kadavu man who was convicted for unlawfully cultivating the illicit drugs on September 26, 2016 in his home village of Naqara in Ono.

The drugs have been ordered for destruction at the end of the 30 day appeal period or as directed by the Court of Appeal.

The accused, Alifereti Ratokabula, was sentenced to 12 years imprisonment with a non-parole period of 11 years.

The Court heard that the accused was married with a daughter and lived in the village with his family and father.

He was a subsistence farmer and planted kava, taro and cassava for a living.

Prior to the day of the incident, Police received information that the accused was cultivating marijuana.

The accused was spotted by Police returning from the farm after watering his marijuana plants. With the help of the village headman, his house was located and upon questioning, he admitted that the plants were his.

While sentencing Ratokabula, Justice Temo said the sentence was designed to punish him in a manner that is just in all circumstances, to protect the community from people like the accused and to deter other would-be offenders.

Justice Temo also stated that the sentence signified that the court and the community denounce the commission of such offence.
