Solicitor General Sharvada Sharma indicated in the High Court in Suva yesterday that they intended to make an application to strike out the judicial redress application filed by Sun Insurance Company Limited.

He said that they would be serving court papers for the same.

Sun Insurance applied for judicial redress of various alleged contraventions of the Bill of Rights embodied in Fiji’s 2013 Constitution.

They instituted proceedings on February 28, 2018 claiming uncompensated deprivation of its property following the start of the Accident Compensation Act enacted by Parliament last year.

They claim that the repeal of the Motor Vehicles (Third Party Insurance) Act 1948 effectively extinguished the CTP insurance business it had conducted for the past 18 years.

They also submitted that the Bill of Rights prohibits the acquisition or expropriation of SUN’s proprietary interest in its established CTP insurance business.

Mr Sharma appeared with co-counsel Ofa Solimailagi before Judge Justice David Alfred on behalf of the Attorney-General who is named as the defendant to the action.

Adish Narayan appeared alongside Julian Moti as counsel for Sun Insurance.

The matter has been adjourned to April 5, 2018 to deal with the strike out application.
