Stepfather, 29, Gets 14 years for Rape of Stepdaughter, 11

A 29-year-old step­father will spend 14 years in jail for raping his 11-year-old step­daughter.

The accused, who was con­victed by the High Court on Tuesday, was also issued a Domestic Violence Restrain­ing Order (DVRO).

The incident happened in Tailevu on May 6, 2017.

While sentencing the ac­cused, Justice Thushara Ra­jasinghe said the sentence was founded on the princi­ple of deterrence in that the accused person was socially abhorrent. He said the of­fence was very serious and that the rape of children was the worst kind of crime.

Justice Rajasinghe said the accused breached the trust as a stepfather and that his duty was to look after his stepdaughter with love and care.

The age difference between the accused and the victim was taken into considera­tion and the fact that he de­nied her rights when he committed the offence on her.

Justice Rajasinghe said the level of harm was high in that the accused took ad­vantage of his stepdaughter when she was alone and the offence affected the victim psychologically.

The court heard that the accused was not a first of­fender and that he had six previous convictions, two of which happened within the past 10 years.

Accordingly Justice Rajas­inghe said he would not give any discount for previous good behaviour.

In mitigation, the accused’s lawyer Filimoni Vosarogo submitted his personal and family background.

However, Justice Rajasin­ghe said it had no mitiga­tory value. The accused was ordered to serve 12 years of his sentence before he could be eligible for parole.
