Legal Aid lawyer Lavinia David yester­day requested for a copy of the Closed-Circuit Television (CCTV) footage from the remand facility where her client al­legedly assaulted a prison officer.

Ms David appeared in the High Court in Suva for her client Gabriel Waqa who is charged with one count of aggravated robbery.

She said her client was held in remand at the Naboro Maximum Prison because he alleged­ly assaulted a Fiji Correction Services officer and was found with a mobile phone.

She requested for more time to consult with Waqa because she had to seek the Commis­sioner of Prisons approval before visiting her client.

She said this sometimes delayed meeting with clients.

Ms David requested her client be released on bail on the ground that his constitutional rights had been breached when he was moved to the Naboro Maximum Prison.

State lawyer Shirley Tivao said they had to liaise with the Fiji Correction Services if the CCTV footage could be released.

Ms David said it would help formulate the defence’s response to the affidavits tendered by the State.

The case was adjourned to May 10, 2018, for mention before Justice Thushara Rajasinghe. The accused has been further remanded in custody.
