Lawyers in a rape case retrial were advised by High Court judge, Justice Thushara Rajasinghe, to find out if he could continue with the matter pending an appeal in the Supreme Court.

The case was ordered for a retrial after the Court of Appeal’s decision.

Legal Aid Commission lawyer Lice Manulevu said the defence had filed an appeal in the Supreme Court because of grievances with the Court of Appeal’s decision.

The accused is charged with one count of rape and the alleged incident happened on December 26, 2012, at the Flea Market premises where the accused was working as a security officer. He was acquitted in the High Court on March 28, 2014.

Justice Rajasinghe questioned State lawyer Shirley Tivao if proceedings should be stayed pending the decision of the Supreme Court. He asked both lawyers to find out what legal provisions there were to allow him to attend to the matter pending the accused’s appeal.

Both lawyers have been given one week to clarify the issue.

The case has been adjourned to June 8, 2018, for mention. The accused is on bail.
