73-Year-Old Gets 13 Years Imprisonment For Rape, Non-Parole Period Of 9 Years

A 73-year-old Tailevu man was sentenced to 13 years imprisonment by the High Court in Suva on Wednesday with a non-parole period of nine years.

The accused raped his 13-year-old grand-niece on two separate occasions at a pig pen between August 1-31, 2015 and October 1-31, 2015.

He maintained a not guilty plea throughout trial and was unanimously found guilty by the three assessors.

Justice Riyaz Hamza convicted him after he up­held the assessors’ opinions and also found the ac­cused guilty of rape.

The complainant testified that in August, the ac­cused tried to lure her by showing her $5 from his house, however when she ignored him he followed her to the pig pen.

She said he raped her at the pig pen and again in October he threatened her before raping her again.

Justice Hamza said sentences are imposed to protect women from such crimes.

He told the accused that as the girl’s grand-uncle he should have protected her.

He also took note of the age disparity between them which was substantial.

Justice Hamza said the accused took advantage of the girl’s vulnerability and had exposed her mind to sex at such a young age.

The child also said in her evidence that the of­fence affected her school performance.

In mitigation the accused stated that he was wid­owed and had five children.

He worked on a contractual basis as a cleaner with the Suva City Council.

The Court also heard that he had four previous convictions which were all recorded in the 1970s.

Justice Hamza told the accused that because of his shameful conduct, his grand-niece would suf­fer all her life.
