Sentencing Deferred

A man facing aggravated burglary and theft charges has had his sentence deferred in the High Court in Suva.

Kitione Lui appeared before Justice Daniel Goundar to be sentenced.

However, Justice Goundar deferred sentencing to wait for the accused’s sentence in the Nasinu Magis­trates Court.

Justice Goundar said the danger in sentencing the ac­cused was double counting his remand period.

And also the High Court had to consider whether the sentence should be consecutive or concurrent to what is imposed in the lower court.

He said unless and until Magistrate Sufia Hamza sentenced Lui then the High Court would impose its sentence.

Lui said his sentence in the Magistrates Court had been pending for three weeks as Magistrate Hamza had not been having court sittings.

He said he was expected to appear in the Nasinu Mag­istrates Court on June 26, 2018.

As per the information received from the accused, Justice Goundar adjourned his case to July 4, 2018 for sentencing.

He said he hoped the accused would have been sen­tenced by then so that he could procure a copy of the Magistrates Court decision and decide the accused’s High Court sentence accordingly.

Lui is on remand.
