Man who allegedly raped male cousin appears at the High Court in Suva

A man alleged to have raped his 21-year-old male cousin appeared in the High Court in Suva, yesterday. The accused is charged with one count of rape where he allegedly had carnal knowledge of his cousin in Nausori on July 6, 2014, without his consent.

The accused was 27-years-old at the time of the offence.

While opening her case to the three assessors yesterday, State Prosecutor Susan Serukai said the complainant placed extreme trust and faith in the accused, who was in a position of authority.

Legal Aid Commission lawyer Sunil Kumar is representing the accused in trial. Ms Serukai said the complainant’s medical examination was conducted on August 30, 2014. She told the assessors to remember that consent should be free and voluntary and not by force.

She said the complainant was dependent on the people around him for care and support, however, this was breached by the accused when he committed the offence.

The court heard that the defence would call three witnesses namely the complainant, his sister who will testify to what the complainant told her and a third witness who would testify to what he discovered the day after the alleged incident.

The complainant gave evidence in a closed court sitting before Justice Riyaz Hamza yesterday.
