Former Lieutenant Sues RFMF

The case involving a former Lieutenant in the Republic of Fiji Military Forces has been adjourned to July 26, 2018 for Pre-Trial Conference (PTC).

Seniroqa Colati, the plaintiff, had filed a lawsuit against the RFMF on April 12, 2017 claiming a sum of $447,662.42 in salary from 2010 to 2017.

The facts of the case revealed that on May 18, 2010, Mr Colati was sent on leave without pay after a Board of Inquiry was set up to investigate allegations against him for the alleged unauthorised purchase of vehicle spare parts.

On August 2, 2011 the Board completed its investigations and found no evidence to support the allegations.

Subsequently the Board recommended that Mr Colati be reinstated back into the force, however this was never done to date.

The cause of action filed by Mr Colati detailed that the RFMF’s unlawful action had resulted in Mr Colati and his family having to endure hardship, trauma, shame and embarrassment.

It also stated that his reputation had been adversely affected and he had been unable to find alternative employment since.

He is seeking relief from the Court for damages, costs and interest at nine per cent on every year of lost salary.

His lawyer Isireli Fa informed Master Vishwa Sharma that the list of documents had been provided by the parties.

Mr Fa requested for 21 days for PTC.

Lawyer from the Attorney-General’s Office Geraldine Naigulevu appeared for the second defendant.

No appearance was noted for the RFMF.
