A 20-year-old woman and her father were further remanded in custody by the High Court in Suva after they appeared on charges of common assault and act with intent to cause grievous harm.

The father and daughter are alleged to have assaulted the father’s de facto partner with a cane knife.

The alleged incident happened on June 13, 2018. State lawyer Bhavna Kantharia appeared for the prosecution and asked for 21 days to file information and disclosures to the defence.

Defence lawyer Ashneel Nand confirmed that there was no domestic violence restraining order issued in the Magistrates Court.

Justice Thushara Rajasinghe issued an interim DVRO against the father and imposed non-molestation and no contact orders.

The accused was warned that if he breached the orders he could be charged and prosecuted for an offence.

Mr Nand was then advised to file a formal bail application in the High Court registry.

Ms Kantharia said the State was not objecting to the woman’s bail because she was a first offender. However, she said, they were objecting to the father’s bail because he had pending matters in the magistrates court.

Both accused persons were further remanded in custody and their case has been adjourned to July 25, 2018, for plea before Justice Daniel Goundar.

Justice Rajasinghe said bail could not be decided in the absence of a formal bail application.

Meanwhile, the male accused sought protection from the court after he told Justice Rajasinghe that he had been tortured while in the Suva Remand Centre.

He claimed he was being punched and he needed security in remand.

Justice Rajasinghe advised the accused to liaise with his lawyer Mr Nand who would make the necessary applications before the court.
