A 33-year-old woman was handed a three-year, 10 months jail term with a non-parole period of one year and 10 months by the High Court in Suva.

Sangeeta Devi was convicted of manslaugh­ter by Justice Vinsent Perera yesterday.

Devi was found guilty of manslaughter af­ter a trial.

On January 9, 2016, Devi caused the death of her newborn child by not getting medical assistance during the delivery.

The child because of excessive bleeding as a result of its umbilical cord not being clamped.

While reading out the sentence, Justice Perera told Devi: “You have caused the death of a human being at its most innocent and vulnerable state.

“You brought the infant to this world and you had the responsibility above anyone else at the material time to ensure that the deceased lives.” Justice Perera said that the state prosecution had urged that the court should treat causing the death of a child more seriously than causing the death of an adult when it came to sentencing.

On the other hand, Justice Perera said the defence counsel had submitted that the loss of a child was a lifetime trauma to a mother and the factor should be taken into consid­eration.

Devi was sentenced yesterday and given 30 days to appeal to the Court of Appeal.
