Chief Justice Anthony Gates has dismissed the appeal filed by the Fiji Independent Commission against Corruption challenging former Prime Minister Sitiveni Rabuka’s acquittal.
While delivering his appeal judgment, Justice Gates ordered FICAC to pay Mr Rabuka $4000 in costs within 14 days.
He said the essential elements of Mr Rabuka’s charges were not proved and the duplicity in the charges was fatal to FICAC’s case.
He said good character had not been put fully in issue and FICAC had relied on Mr Rabuka’s caution interview to establish knowledge of falsehood.
Justice Gates said undoubtedly there was co-operation by a busy person with the investigative agency.
