Man Gets 7 Years for Sexual Assault, Rape of Step daughter

High Court Judge Justice Chamath Morais yesterday told a 24-year-old former firefighter that he had a duty to protect his stepdaughter, but he failed to do so.

Justice Morais’ comment was made after a man was convicted and sentenced for one count each of sexual assault, attempted to commit rape and rape of his stepdaughter.

On March 16, 2017, in the Central Division, the man had unlawfully and indecently as­saulted the victim, attempted to have carnal knowledge with her and raped her.

The man was in a relationship with the complainant’s mother and was the com­plainant’s stepfather.

Justice Morais said the severity of rape has been highlighted by the Fiji Court of Appeal on many occasions.

“Children are out future. Society cannot condone any such offences against the chil­dren. The Courts must protect women and children from such offences and trauma.

“The victim had suffered psychological and mental trauma.”

The man was sentenced to seven years, nine months and 15 days imprisonment with a non-parole period of five years, nine months and 15 days.

He was given 30 days to appeal to the Fiji Court of Appeal.
