A Tacirua man accused of raping a 58-year-old woman has had his case transferred to the High Court because it was a serious offence.

The accused, Sevanaia Baleinadi, 37, appeared in the Nasinu Magistrates Court on Tuesday before Magistrate Charles Ratakele. Baleinadi requested for assistance from the Legal Aid Commission.

He is charged with five counts of rape, three counts of assault causing actual bodily harm and one count each of damaging property, criminal intimidation and robbery.

The accused allegedly raped a woman on two separate incidents on January 7, 2019 and January 17, 2019 at Nasinu.

He is alleged to have assaulted the complainant by dragging her to the bush and in the process damaged her eye glasses.

Then he allegedly sat on her chest and punched her face before repeatedly raping her. The court also heard that Baleinadi allegedly punched the woman’s mouth and bit her arm then he threatened to kill her and her sons and burn her house.

On the same day that he allegedly raped her, Baleinadi robbed the complainant’s Nokia mobile phone valued at $250, her brown coloured sling bag valued at $25, a gold ladies wrist watch valued at $35 and $5 in cash, all to the total value of $315.

Police prosecutor Constable Setareki Mocevakaca served the accused with full phase disclosures.

Magistrate Ratakele told Baleinadi that the alleged offences he was charged with were indictable in nature and had to be transferred to the High Court in Suva.

The accused was remanded in custody and the case been adjourned to February 1, 2019 for first call.
