Nasinu Court Remands Alleged Death Driver

The 40-year-old bus driver alleged to have run over a 69-year-old vegetable seller of Davuilevu was remanded in custody by the Nasinu Magistrates Court on Thursday.

The accused Francis Jitendra Joseph appeared before Magistrate Charles Ratakele and was represented by a private lawyer.

He is charged with one count of dangerous driving occasioning death.

It is alleged that on January 22, 2019 the accused drove a bus with registration IY 857 along Adi Davila Road in Davuilevu in a manner which was dangerous to the public and caused the death of Subba Naidu.

Police prosecutor Constable Setareki Mocevakaca sought the court’s leave to serve the accused with full phase disclosures and indicated that the State would be objecting to his bail.

Joseph’s lawyer said he was ready to make oral submissions for his client’s bail, however Magistrate Ratakele advised him to file and serve a formal bail application to the State by close of business yesterday.

Magistrate Ratakele said this would give the State time to respond to the accused’s bail application before a bail ruling was given on Monday January 28.
