30-Year-Old Man Acquitted Of Rape Charge

A 30-year-old man who was charged with one count each of rape and sexual assault was acquitted from all charges by the High Court in Suva on Tuesday.

Judge Chamath Morais, while delivering his judgment, said the prosecution was unable to prove the case beyond reasonable doubt.

The alleged incidents took place between April and May 2018 in the Central Division. The complainant was said to be 13 years old.

Judge Morais said at the conclusion of the evidence and after the directions given in the summing up, the three assessors unanimously found the accused guilty to both the counts.

However, he said he directed himself in accordance with the law and the evidence led in this case, inclusive of which he has discussed in his summing up to the assessors.

Therefore, Judge Morais acquitted the man accordingly.
