Man, 56, jailed for rape and sexual assault offence

A 56-year-old Nasinu man yes­terday was jailed for eight years for rape and sexual assault charges.

The man was handed a non-parole period of six years.

He was sentenced by Suva High Court Judge Justice Thushara Ra­jasinghe.

The accused on October 17, 2018, in Nasinu, had raped and sexu­ally assaulted his niece who was 40 years old at the time of the offence.

While sentencing, Justice Rajasin­ghe said the act was an opportunist offence and the man had breached the trust of his niece.

“As the uncle of the victim who is your niece, you had breached her trust and took the opportunity at that time.

“The age difference between you and the victim was big.

“The accused was remorseful and had pleaded guilty to the offences at the earliest opportunity,” Justice Rajasinghe said.

He also noted that the man had spent four months and two days in remand for the matter and deduct­ed five months from the sentence leaving the sentence to serve seven years and seven months with a non-parole period of five years and sev­en months.

Justice Rajasinghe also issued a permanent domestic violence re­straining order.

The man was given 30 days to ap­peal to the Fiji Court of Appeal.
