The Saint Giles Psychiatric Hospital has determined in a report that a 21-year-old farmer facing a murder charge is unfit to stand trial.

High Court judge Justice Daniel Goundar read excerpts of the report in court yesterday before remanding Fabiano Dakai in custody.

However, State prosecutor from the Office of the Director of Public Prosecutions Sadaf Shameem told the court that the result would require an inquiry to determine whether Dakai would remain at the Suva Remand Centre or be admitted at the Saint Giles Hospital.

Defence lawyer from the Legal Aid Commission Namrata Mishra told the court that she was informed by personnel at the Saint Giles Hospital that the accused was taken there for a therapy session and that his psychiatric evaluation report was filed.

Justice Goundar read the report in court which, in conclusion, said the accused was unfit to plead in court, not capable to go through the proceedings, had symptoms of mental illness and was influenced by mental illness at the time of the alleged incident.

Ms Mishra told the court that the remand centre provided the accused with the medicines he required, but he would have to be taken to the hospital for therapy sessions.

Justice Goundar also raised concerns on whether Dakai could pose a risk to other remand prisoners if he remained at the Suva Remand Centre.

He gave 14 days to the State to advise whether the ODPP would proceed with the charges and if the accused was fit to stand for trial after the inquiry was conducted.
