Farmer Pleads Guilty To Rape, But Not Sexual Assault

A 54-year-old Tailevu farmer yesterday pleaded guilty to a count of rape of a nine-year-old girl.

However, the accused pleaded not guilty to a count of sexual assault.

He appeared before High Court Judge Justice Daniel Goundar yesterday.

It is alleged that the man raped and sexually assaulted the complainant on January 17, 2019.

Defence lawyer from the Legal Aid Commission Anil Chand told the court that the accused did not understand the charge of sexual assault and pleaded not guilty.

However, he told the court that the plea of not guilty was contradictory to the instructions obtained from the accused.

Justice Goundar said the accused needed to understand the consequences of the charges.

The case has been adjourned to July 8 for plea on the charge of sexual assault, mitigation and sentencing submissions.
