A 49-year-old man has been told by a High Court Judge that his sexual acts with his biological daughter will haunt her for the rest of her life.

Justice Vinsent Perera said this while sentencing the man to five years imprisonment with a non-parole period of three years for the offence of sexual assault.

The father of three was found guilty by the High Court in Suva for sexually exploiting his 11-year-old daughter in March, 2015.

While sentencing the man, Justice Perera said to the man that he had breached his trust as a father and guardian of his biological daughter.

“You sexually exploited your own daughter when you were supposed to be her most trusted person.

“You breached the trust of your daughter as a father and her guardian.

“The offence you have committed will haunt her for the rest of her life. And not only that, you have exploited her vulnerability,” Justice Perera said.

The court heard that the man was separated from his wife in March, 2015, and during the same period, the offence took place.

The man was jailed for five years with a non-parole period of three years.

The court noted that the man had served three months and 22 days in remand, which was included in the head sentence.

The final term for the man to serve was four years, four months and 22 days imprisonment with a non-parole period of two years.

Justice Perera also issued a domestic violence restraining order due to the closeness of the relationship between the man and the victim with a permanent non-molestation and non-contact orders to protect the victim under the domestic violence act.

The accused was given 30 days to appeal to the Fiji Court of Appeal.
