As her partner, you should have protected her, but instead you have breached her trust.

This was the strong message by High Court Judge Justice Riyaz Hamza while sentencing a former security officer to 10 years imprisonment for rape and assault offences.

The former security officer was charged with three counts of rape and assault causing actual bodily harm. The offence took place in August 2016.

The complainant in the matter was the man’s de facto partner.

The court acquitted him for the first count of rape, however, he was convicted for two other counts of rape and one count of assault causing actual bodily harm.

The court heard that the man was in a de facto relationship with the complainant for 11 years and had four children together. The man was jailed for 10 years with a non-parole period of eight years.

The court noted that the man had served 15 months in remand, which was counted as the part of his sentence.

Justice Hamza said the term remaining for the accused to serve is eight years and nine months with a non-parole period of six years and nine months.

Justice Hamza also issued a domestic violence restraining order due to the closeness of the relationship between the man and the complainant with a permanent non-molestation and non-contact orders to protect the victim under the domestic violence act. The man was given 30 days to appeal to the Fiji Court of Appeal.
