Step-father Sentenced To Six Months For Indecent Assault

A 34-year-old step-father was sentenced to six months imprisonment by the High Court  in Labasa yesterday.

The father of three children appeared before Judge Justice Daniel Goundar.

He was charged with one count of digital rape to which he pleaded not guilty, and one count of indecently insulting the modesty of a person to which he pleaded guilty.

He was represented by Legal Aid Commission lawyer Karen Boseiwaqa.

For the first count of digital rape, a pre-trial conference has been adjourned to August 9.

For the second count it was alleged that the accused on March 23, 2019 used words of insult, telling his 12-year-old step daughter to see and touch his private part while she was having her shower in an enclosed laundry area.

The court heard that the girl shouted for help.

Justice Goundar said a deterrent must be made and sentenced the man to six months imprisonment.

Justice Goundar said in this case the girl had a terrifying experience where the step father insulted her by using words.

He said the age gap was huge and being an authority figure, the accused breached the girl’s trust.

The accused had one previous conviction of criminal intimidation of his wife in 2009.
