You have to live with the guilt of killing your daughter whom you should have protected and cared for.

Suva High Court Judge Justice Vinsent Perera made the remarks while sentencing 35-year-old Rozleen Razia Khan to life imprisonment for the offence of murder.

Khan was convicted and sentenced for the murder of her four-year-old daughter.

Khan had tied herself with her daughter and jumped into the Rewa River on May 6, 2018, which resulted in the death of her daughter.

“You wanted to kill yourself and your daughter because of your family problems and the fact that your husband had served the custody papers of your children which led to you to make that decision,” Justice Perera said.

“Your daughter was vulnerable and depended on you to protect her and care for her.

“You had an extra-marital affair for five years and your family knew about it. You had pre-determined the offence of killing yourself and your daughter.”

Defence lawyer Gavin O’Driscoll on Thursday had requested the court to not set a minimum term in the sentence so that Khan could apply for a pardon to the Mercy Commission.

Justice Perera in his sentencing said that it was appropriate for him in this case to not fix a minimum term under Section 237 of the Crimes Act.

Justice Perera sentenced Khan to mandatory life imprisonment and gave her 30 days to appeal to the Fiji Court of Appeal.
