A Congo national, who is facing a charge of murdering his wife, has claimed in court that he may have been framed by his deceased wife and his father-in-law.

Judge Justice Daniel Goundar told the 39-year-old Kiala Marcellino Penakoy Henri Lusaka to not incriminate himself and answer questions of his legal representation.

Lusaka appeared before Justice Goundar at the High Court in Suva, charged with one count of murder of his 44-year-old wife, Jennifer Anne Downes, an Australian national.

The alleged incident occurred on July 23, 2019, at their home in Service Street, Suva.

Lusaka is expected to engage a private lawyer. However, he claimed having written to a local lawyer among others, but no response was forthcoming.

He also claimed he had no access to phones at the remand centre to make calls.

Lusaka told the court that the Police had seized his passports together with his credit card and debit card.

Justice Goundar had suggested that Lusaka engage a Legal Aid Commission lawyer to assist him in the meantime.

Lusaka told the court that the commission was not much of a help to him. He has also filed his bail application.

Prosecutor Assistant Director of Public Prosecutions Elizabeth Rice said the State had not received a copy of his bail application and would oppose bail application because of the seriousness of the case.

Ms Rice sought 21 days to file for disclosures.

She also told the court that the Office of the DPP had obtained a copy of the post-mortem examination report of the deceased.

The matter has been adjourned for mention and bail hearing to September 13.

Lusaka has been further remanded in custody.
